Until the auction
Bidder support

We review the valuation report, arrange the viewing, set the bidding strategy and bid limit with you and represent you at the auction – you pay a flat fee for the review and a success fee only if you win the award.

How a German foreclosure auction works

Value thresholds at the first date

If the highest bid including rights that remain in place does not reach 5/10 of the market value, the award is refused (§ 85a ZVG). Below 7/10 a creditor may apply for refusal (§ 74a ZVG). These thresholds no longer apply at a second date.

Security deposit 10 %

A security of 10 % of the market value may be demanded at the auction – by timely transfer to the court cashier, bank cheque or bank guarantee, never in cash. You always provide it yourself, directly to the court.

Rights that remain in place

Certain land register rights remain in place and are added to the bid. The law firm of your choice clarifies this before the auction.

The award is not a purchase agreement

With the award you become the owner by sovereign act – without a notary and without warranty for defects. The highest bid must be paid by the distribution hearing.

Bidder support services

Dr. Hofeditz Real Estate GmbH (licensed real estate broker under § 34c GewO) supports you through the procedure:

  • –Review of the official notice and valuation report, value indication
  • –Viewing, where possible via the receiver or the owner
  • –Bidding strategy and bid limit taking into account thresholds and acquisition costs
  • –Organisation of the security deposit (amount, form, deadline)
  • –Financing on request via our financing partners
  • –Representation at the auction with a publicly certified bidding power of attorney – only on your written instruction with a fixed maximum bid
  • –Support after the award: payment, distribution hearing, handover, tenants
Legal and tax review

We do not provide legal or tax advice. The land register, rights that remain in place and procedural questions are reviewed by a law firm of your choice. On request we put you in touch with a law firm experienced in German foreclosure law.

Third-party costs

Not included in our fees and borne by you: legal and tax advice, technical due diligence, court and land register fees, real estate transfer tax, financing costs. We coordinate, but do not engage anyone at our expense.

No client funds

We do not accept any funds. You pay the security deposit and the highest bid directly to the court.
